1099-NEC vs 1099-MISC: Key Differences, Deadlines, and What to Do When You Receive One

The IRS split nonemployee compensation into its own separate form โ€” 1099-NEC โ€” back in 2020. Yet many freelancers and small business owners are still confused about which form applies to them, what the reporting thresholds are, and what tax implications each carries. This guide clears it all up.

Why the IRS Split 1099-MISC into Two Forms

Before 2020, freelancers received all their income on Form 1099-MISC in Box 7 (Nonemployee Compensation). The IRS revived the dormant Form 1099-NEC specifically to report freelance/contractor pay, separating it from the other types of miscellaneous income that remain on 1099-MISC.

The main driver was filing deadlines. Nonemployee compensation on 1099-NEC is due to recipients and the IRS by January 31 โ€” the same deadline as W-2s. The other 1099-MISC boxes have a later February/March deadline. Separating the forms eliminated a long-standing deadline confusion.

Form 1099-NEC: Nonemployee Compensation

1099-NEC stands for "Nonemployee Compensation." A business must send you a 1099-NEC if they paid you $600 or more during the year for services as a non-employee.

Who gets a 1099-NEC?

  • Freelancers, consultants, contractors
  • Gig economy workers (sometimes via 1099-K instead โ€” see below)
  • Attorneys paid for legal services
  • Any individual who performed services as an independent contractor

What Box 1 means

Box 1 on Form 1099-NEC shows total nonemployee compensation paid during the year. This income is subject to both SE tax (15.3% ร— 92.35%) and federal income tax. It flows to Schedule C on your Form 1040.

Form 1099-MISC: Miscellaneous Income

After the NEC split, 1099-MISC covers a wide range of miscellaneous payments that are not contractor pay. Common boxes:

BoxType of IncomeThreshold
Box 1Rents$600+
Box 2Royalties$10+
Box 3Other income (prizes, awards, legal settlements)$600+
Box 6Medical/health care payments$600+
Box 10Gross proceeds paid to attorneys$600+

Note: Rent income on 1099-MISC Box 1 goes to Schedule E (not Schedule C) and is not subject to SE tax unless it's part of a rental business with services.

Reporting Thresholds

The $600 threshold for 1099-NEC applies to payments to any single recipient during the calendar year. If a client paid you $599, they're technically not required to file a 1099-NEC. However, you must still report all self-employment income on your tax return regardless of whether you received a 1099 or not.

โš ๏ธ Important: Not receiving a 1099-NEC does NOT mean income is not taxable. The IRS expects you to self-report all income over $400 in net profit.

What about 1099-K?

If you receive payment through platforms like PayPal, Venmo (business), Stripe, or gig apps, you may receive a 1099-K (Payment Card and Third-Party Network Transactions) instead of a 1099-NEC. For 2026, the 1099-K reporting threshold is $5,000 (phased reduction from the prior $20,000/200 transaction rule). This income is still taxable and goes on Schedule C.

What to Do When You Receive a 1099-NEC or 1099-MISC

  1. Verify the amount. Compare Box 1 on the 1099-NEC to your own records. Errors are common โ€” contact the payer to correct before filing.
  2. Report on Schedule C. 1099-NEC income goes on Schedule C as gross revenue. Deduct business expenses to arrive at net profit.
  3. Calculate SE tax. Net profit ร— 92.35% ร— 15.3% = SE tax. Use our 1099 Tax Calculator for a full breakdown.
  4. Pay quarterly if needed. If you expect to owe $1,000+ for the year, you should be making quarterly estimated payments. See our Quarterly Tax Calculator.
  5. Keep the 1099 for 3+ years. Store with your tax records in case of an audit.

What If You Don't Receive a 1099?

You're still required to report the income. The IRS does not excuse unreported income because you didn't receive a form. Common scenarios where you might not get a 1099:

  • The payer paid you less than $600 (no 1099 required, but income is still taxable)
  • The payer forgot to file or sent it to the wrong address
  • Cash or check payments without formal documentation

In all these cases, report the income on Schedule C based on your own records. If the amount differs from what a 1099 later shows, you can file an amended return.

Frequently Asked Questions

Is 1099-NEC income subject to SE tax?

Yes. 1099-NEC income reported on Schedule C is subject to both SE tax (15.3%) and federal income tax.

What if I received the wrong form โ€” 1099-MISC instead of 1099-NEC?

Contact the payer to request a corrected form. If they won't correct it, report the income on Schedule C and note the discrepancy. The income is taxable either way.

Do I owe SE tax on 1099-MISC income?

Generally no, unless the income is from self-employment services. Rent (Box 1) and royalties (Box 2) are typically not subject to SE tax. Consult a CPA if unsure.

Can I deduct expenses against my 1099-NEC income?

Yes. Business expenses reported on Schedule C reduce your net profit, which reduces both SE tax and income tax.
